1) Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of foxzen.in and related services, apps, and communications (the “Services”). By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy.

2) Eligibility & Accounts

  • You must be at least 18 or the age of majority in your jurisdiction to use the Services.
  • If you create an account, you must provide accurate information, keep your credentials secure, and notify us of any unauthorized use. You’re responsible for activity under your account.
  • If you act for a business, you confirm you’re authorized to bind that business to these Terms.

3) Changes to the Services or Terms

We may update features or these Terms. If we make material changes, we’ll post the updated Terms and change the Effective date (and provide additional notice where required). Continued use after changes means you accept the updated Terms.

4) Your License to Use the Services

We grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal or internal business use, subject to these Terms.

5) Acceptable Use (What you must not do)

You agree not to:

  • break any law or rights of others;
  • upload, post, or share anything illegal, harmful, deceptive, defamatory, obscene, or infringing;
  • attempt to gain unauthorized access, probe, or test the security of any system;
  • copy, scrape, crawl, index, or harvest data from the Services without our prior written consent;
  • reverse‑engineer, decompile, or circumvent access controls or limits;
  • send spam, malware, or conduct high‑risk activities that may disrupt the Services;
  • use the Services to collect or process others’ personal data without a lawful basis and valid notice/consent;
  • use our content or the Services to train AI/ML models without our express written permission.

6) Your Content

  • Ownership. You keep ownership of content you submit (“User Content”).
  • License to Foxzen. You grant Foxzen a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, display, and create derivative works of your User Content solely to operate, improve, promote, and provide the Services.
  • Your promises. You have all rights to your User Content, and it doesn’t violate any law or third‑party rights.
  • Moderation. We may remove or refuse content that violates these Terms or the law.

7) Our Intellectual Property

The Services, including text, graphics, logos, trademarks, and software, are owned by Foxzen or our licensors and are protected by IP laws. Except for the limited license in Section 4, you have no rights to our IP.

8) Third‑Party Services & Links

The Services may link to or integrate with third‑party sites, tools, or payment providers. Their terms and privacy policies apply to their services. We’re not responsible for third‑party actions or content.

9) Purchases, Subscriptions, and Billing (use if you sell anything)

  • Prices & taxes. Prices are shown in INR and may include or exclude GST as indicated. We may change prices with notice where required.
  • Payments. You authorize us and our payment processor to charge your selected payment method.
  • Subscriptions. Plans auto‑renew at the end of each term unless you cancel before renewal. You can cancel in your account settings or by emailing [support@foxzen.in].
  • Trials & promos. Trials convert to paid unless you cancel before the trial ends. Promo terms apply as stated at sign‑up.

10) Privacy & Data

Your use of the Services is also governed by our Privacy Policy (see /privacy). We implement reasonable security measures, respect user rights under applicable laws, and work with processors under contract. Please review the policy to understand how we collect, use, and share data.

11) Communications

By using the Services, you agree to receive service‑related communications (e.g., account, security, transactional emails). You can opt out of non‑essential marketing emails at any time via the unsubscribe link or by emailing [support@foxzen.in].

12) Termination & Suspension

We may suspend or terminate your access if you breach these Terms, create risk for us or others, or if required by law. You may stop using the Services at any time and request account closure. Sections that by their nature should survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution) will survive termination.

13) “As‑Is” Disclaimer

We provide the Services “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties—express, implied, or statutory—including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee uninterrupted or error‑free operation.

14) Limitation of Liability

To the fullest extent permitted by law, Foxzen and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill.
Our total liability for any claim arising out of or relating to the Services is limited to the greater of â‚ą10,000 or the total fees you paid to Foxzen for the Services in the 12 months before the claim.

15) Indemnification

You will defend, indemnify, and hold harmless Foxzen and its personnel from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your: (a) use of the Services; (b) User Content; (c) violation of these Terms; or (d) violation of any law or rights of a third party.

16) Dispute Resolution, Governing Law, and Jurisdiction

  • Informal resolution. Contact [grievance@foxzen.in] first; we’ll try to resolve disputes within 30 days.

17) Copyright & Takedown

If you believe content on the Services infringes your intellectual property, email [ip@foxzen.in] with: (a) your contact details; (b) a description and link/URL to the infringing material; (c) proof of rights; and (d) a statement that your notice is accurate and in good faith. We may remove or disable access to the content and, where appropriate, terminate repeat infringers.

18) Compliance & Grievance Redressal (India)

We aren’t responsible for delays or failures caused by events outside our reasonable control (e.g., internet outages, cyberattacks, acts of God, government actions).

19) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

20) Entire Agreement; Severability; No Waiver

These Terms and any policies referenced (e.g., Privacy Policy, Refund Policy, Acceptable Use) are the entire agreement between you and Foxzen regarding the Services. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
